Powerware Protection Guarantee
Attached Equipment Protection Program Terms and Conditions
Program Summary: Powerware Corporation guarantees to repair or replace (at the option of Powerware Corporation)
any equipment that is damaged by AC power disturbances when said equipment is properly connected to a Powerware
Corporation uninterruptible power supply (UPS) covered by the Powerware Protection Guarantee. This program provides
for reimbursement of repair or replacement expenses up to $25,000.00 and applies only to component or physical system
damage.
Products Covered: The Powerware Protection Guarantee applies to all Powerware Corporation Prestige 3000 UPS
systems that are covered under the original IBM AS/400 Powercare Limited warranty during the manufacturer’s warranty
period.
Applicability: The Powerware Protection Guarantee applies only to units installed in the United States of America, Latin
America, Canada, Asia Pacific and were sold by IBM Corporation with AS/400 systems. Further, this Powerware
Protection Guarantee applies only to end-users of the UPS product(s) who have returned the warranty registration card
within 30-days after product delivery. This program does not apply to damage resulting from any cause other than AC
power disturbances and is independent of the Powerware Corporation manufacturer’s warranty or service contract. The
Powerware Protection Guarantee applies to the following AC power disturbances as defined by the American National
Standards Institute (ANSI): power line transients; electrical spikes; electrical surges; brownout; blackout. UPS products
must be properly maintained according to the manufacturers’ recommendations set forth in the operator’s manual and the
UPS installation must adhere to electrical safety requirements set forth by the National Electrical Code (NEC) or
applicable local code(s). The UPS must be properly connected to a properly installed electrical outlet or other connection
per the NEC or applicable local code (s). The equipment covered by this guarantee must be connected directly to the
output of the Powerware Corporation UPS product with no intervening electrical devices. The Powerware Protection
Guarantee is null and void if the UPS product has been: misapplied; improperly maintained; mishandled; abused;
improperly installed; altered in any way subjected to accident or misuse; used in other than normal operating conditions
described in the UPS product specifications. The Powerware Protection Guarantee is independent of all other warranties
and there are no other warranties expressed or implied, including warranties of merchantability and fitness for a particular
purpose. IN NO EVENT SHALL POWERWARE CORPORATION BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL,
INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF ITS’ PRODUCTS, EVEN IF ADVISED
OF THE POSSIBILITY OF SUCH DAMAGE. Direct, indirect, special, incidental or consequential damages include, but are
not limited to, lost profits or revenue, loss of equipment, loss of use of equipment, software loss, loss of data in whole or
in part, recovery of data in whole or in part, restoration of data in whole or in part, corruption of data in whole or in part,
cost of substitutes or rental equipment, claims by third parties or otherwise.
