3. Limitation of Liability. IN NO EVENT SHALL PSION TEKLOGIX
OR ITS LICENSORS BE LIABLE FOR ANY DAMAGES WHAT-
SOEVER, INCLUDING WITHOUT LIMITATION, DIRECT, INDI-
RECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL
DAMAGES, LOSS OF PROFITS, REVENUE, LOSS OF BUSI-
NESS, LOSS OF DATA OR LOSS OF USE, WHETHER SUCH
CLAIM ARISES IN TORT OR CONTRACT AND IRRESPECTIVE
OF WHETHER PSION TEKLOGIX OR ITS LICENSORS HAVE
ADVANCE NOTICE OF THE POSSIBILITY OF SUCH DAM-
AGES.
4. Ownership of Intellectual Property. All title and intellectual property
rights in the Software provided hereunder, and any copies of the Soft-
ware, are owned by Psion Teklogix or its licensors. This agreement
does not transfer to you any title in or ownership of the Software or
any Psion Teklogix or third party trademarks, nor (except as provided
herein) any right to use Psion Teklogix or third party copyrighted
material, or confidential information embodied therein except the
rights to use the Software as expressly permitted by this agreement.
5. NOTE ON JAVA TECHNOLOGY. The Software contains support for
programs written in Java programming language. Java Technology is
not fault tolerant and is not designed, manufactured or intended for use
or resale as on-line control equipment in hazardous environments
requiring fail-safe performance, such as in the operation of nuclear
facilities, aircraft navigation or communication systems, air traffic
control, certain medical devices, or weapons systems, in which the
failure of Java Technology could lead directly to death, personal
injury, or severe physical or environmental damage. Psion Teklogix
and its licensors disclaim any express or implied warranties for any
such use.
